How to Submit a DMCA Notice

If you are a copyright owner or an authorized agent thereof and believe that any content hosted on The Level Up Path infringes your copyright, you may submit a DMCA notice by following these steps:

Step 1: Prepare a Written Notification

Ensure your written notification includes all of the following information, as required under the DMCA (17 U.S.C. § 512(c)(3)):

  • Identification of the copyrighted work you claim has been infringed.
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and that is to be removed or access to which is to be disabled, with information reasonably sufficient to permit us to locate the material (e.g., direct URL).
  • Your full legal name, mailing address, telephone number, and email address.
  • A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

Counter-Notification Process (for False or Mistaken Claims)

If you believe that content you posted on The Level Up Path was removed or access to it was disabled by mistake or misidentification, you may submit a counter-notification to have the content restored, as permitted by the DMCA (17 U.S.C. § 512(g)).

Step 1: Prepare a Written Counter-Notification

Your counter-notice must include the following details:

  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled (e.g., the specific URL).
  • A statement, under penalty of perjury, that you have a good-faith belief that the content was removed or disabled as a result of mistake or misidentification.
  • Your full name, address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if you are outside of the United States, that you consent to jurisdiction in any judicial district in which The Level Up Path may be found), and that you will accept service of process from the person who submitted the original DMCA notice or their agent.
  • Your physical or electronic signature.

Upon receiving a valid counter-notice, we may forward it to the original complainant. If the complainant does not file a lawsuit within 10–14 business days, we may restore the removed content at our discretion.

Repeat Infringers Policy

The Level Up Path takes copyright infringement seriously and enforces a strict repeat infringer policy in accordance with the Digital Millennium Copyright Act (DMCA) and applicable intellectual property laws.

We maintain a record of all valid DMCA notices and counter-notifications. Users found to have repeatedly violated copyright laws—such as by uploading or sharing content that infringes on the rights of others—may be subject to:

  • Account Suspension or Termination
  • Permanent Revocation of Access to Our Services
  • Removal of All Associated Content

A “repeat infringer” is typically defined as any user who receives two or more valid DMCA takedown notices or who demonstrates a pattern of infringing behavior. However, we reserve the right to terminate accounts at our sole discretion after a single incident, depending on the severity of the violation.

We encourage all users to respect intellectual property laws and use only original or properly licensed content. If you believe your account was wrongly suspended under this policy, you may contact us with a valid counter-notice (see the section above).
